law

Disclaimer: all the contents in this post/blog are purely my sole opinion/speculation from hearsay and has nothing to do with any other person/entity or representing the view of any company/organization. The accuracy of the content is my pure interpretation at my best knowledge and should be used at your own risk & discretion.

Aside from getting some idea about house reno, I met some interesting friends just now at my friend's house warming. Actually, I only knew a few of them, and they all are bunch of high school friends who have been through thick and thin.

Since I went there alone, I joined into their group of school friends as an "alien", listening to their catching up & remember-the-good-old-school-day conversation. Kinda awkward, but they all are very friendly and welcomed me warmly, therefore I chipped into the conversation as well =)

One particular topic that I want to share about in this post is a couple of interesting cases in today's laws world. Apparently, lawyers do discuss day to day cases or top cases in the country (sourced from BAR) with other lawyers (and sometimes with friends) as part of their experience enriching/gaining process.

As a matter of fact, most of my friends are engineers, and rarely anyone from the law side. The only law realities that I have been exposed to are the house loan agreements, the "Lingam" case and some cases that being "rehearsed" in the "comedycourt". I mean, how often can you heard about real cases quote from a lawyer? Very interesting and funny, because law is created by human to organize human, but it is not perfect =)

Both cases are about marriage

Case1
There is this one recently top case being discussed and only to be known in today's Malaysia "law world", where a plaintiff institutes a suit in court to sue her husband for causing her to lose her virginity. But the thing is, they had registered as husband and wife some years back, had wedding reception too, but thing takes a u-turn this day, causing some "unhappy feeling" that leads to this "interesting" suit. The most interesting part is, the lawyers did went to a great length in discussing the case, including finding a standard/method to define virginity etc

Case2
A wife called up a lawyer seeking consultation, asking for advice whether to "divorce" or to "nullified of marriage" (I don't really remember the exact term, but I directly translate from mandarin). Although both term seems alike, but they are different. The wife claimed that she and her husband have NOT had sex before although they have been registered for 2 years. Reason is the wife and husband stayed separately, and they are the conservative one who think they can only do "that" after the traditional wedding reception. Therefore, ideally AND in this case AND if the wife claim is true, the "nullified of marriage" is the path to go, because with this, the girl is still "jade girl" (directly translated from mandarin). But the lawyer cant believe her, although not probable. Because if the lawyer took up the case, the lawyer will be in an awkward position in front of judge if the husband claimed that they had sex before. I mean, how to prove that? It will be a long................ case...............

Moral of the 2 stories, marriage cases are complicated to handle for lawyer yet interesting, and if a lawyer want to be on the safe side & 9 to 5 routine, better stayed on the property cases. Just a thought =)

Lastly, in an unrelated note, all hail to the not-so-new government initiative to reform the judiciary system in our country from the highest level.

United Malays National Organization blog?

something interesting to read.

Malaysian candidates required to have blogs

some exerptions:-

"In the past, party politicians have said bloggers spread lies and rumors. Many of Malaysia's blogs contain commentary critical of the government."

"But now, even youth deputy Khairy Jamaluddin -- who once compared bloggers to monkeys living by the law of the jungle -- has a blog."

Although blogging has caught the attention of many Malaysian politicians nowadays, let just hope that it is not used as a "puppet instrument" in any deceiving ways for the "new-adopters", that maybe someday makes blogging becoming the politician-worst-nightmare ==> "irrelevant".

eavesdropping

Compare between a village and a city, we tend to interact with strangers more in the city.

People lives in a denser proximity in the city, yet we barely knew each other sometimes. Besides, it is hard not to eavesdropping on other people conversation sometimes, like in a shopping mall or in a hawker stall.

So, for this post, I present you with the eavesdropping case1 and case2.
(xwei, dont call out for SPY ALERTTTTTT!!!! ya "p)

case1
This is a very short eavesdropping. I was walking around HOMEDEC 08 last weekend. And while I was passing through a water heater exhibition both, I overheard a man was making the following remark to his friend about the water heater unit on display in Hokkien (translated to english of course).

"you see, the water heater even have blue light (LED light actually), got use meh?"

Come to think of it, the water heater indeed have blue LED light that I dont see have any usefulness/functionality except fancy look.

case2
I was taking my breakfast this morning at a hawker stall. Business was slow since it rained early in the morning and the hawker stall is an outdoor type. Little customers ordered take away and I was sitting quite near to the stall under the big umbrella thingy enjoying my bowl of "koay teow th'ng".

There was a customer who seems like a regular one chatted away on a few topics/gossips with the stall owner while he is preparing the take away.

I remembered one topic they talk about is the RapidPenang bus operators clash with other bus operators in town issue. They make some remarks and blame the crisis to the way the State Administration/Municipal Council or what so ever for allocating same routes to 2 different operators, causing stirs that still unresolve until today. They even suggested a simple solution to fairly divide out the routes for the operators. Come to think of it, although the proposal is simple, but is a straight forward solution. Sometime, the solution to a problem dont need to be fancy or complicated, it just need to be simple.

Another thing that enlighten me is, hawker stalls/centres are a good source of "information" too =)

who is Sufiah

The name Sufiah is an average Jane to me until I read about her prostitution news on TheStar here a while back.

Then, I read about some blog posts on TheStar here and here.

I couldnt agree more to address the issues (orphan, single mother, poverty etc) that is near to us at our very homeland, than Sufiah who is now 23, "gifted", took government scholarship, chosen PR in foreign land, chosen the way of prostitution etc

Who is she until she is so "unique" and "special" that require the "personal care" of Prime Minister's Department and the Malaysian Missionary Foundation (Yadim)?

Am not denying Sufiah the help if she really need it. If she need it, she would ask for it. Only if the orphan, single mother, teenagers etc in Malaysia refused the help, then you (Ministries) can offer you assist to Sufiah as part of your "promotion" campaign.

bus services

I had a little "hiccup" last weekend when traveling back from KL by bus. I think for the first time, I missed a purchased bus ride due to an unforseen traffic jam caused by a road accident. I reached Shah Alam bus station at 10:25am though for the 10:30am bus. Apparently, the bus has departed a little bit earlier when I reached, which is unusual and very rare.

Although me and my friend protested, we were brushed aside by the agent with excuses like announcement of the departure has been made over the loudspeaker etc. They couldn't even help by trying to call the bus or give us the bus driver's h/p number so that we could catch up with the bus. The only offer they are selling me is the 12noon bus ride.

Call me/I am racist, I personally think majority of "pure local" only looks at short term profit and never thought of the service that they are offering for the long term gain. Undeniebly, non "pure local" are sometimes like that too, but these "pure local" are abundant. I will NEVER buy bus ticket from that company ANYMORE and will tell the tale as long as I live, something about "sutera", so that it is known by other, a pledge that I had made on that day =)

I am not really in a rush, but my friend already late for work by half a day. So, I asked him to send me to the nearest Kelana Jaya LRT station, took LRT to Masjid Jamek, changed to STAR line to Plaza Rakyat, bought a on-the-spot bus ticket and departed from Pudu at 12noon. I would glad to go through the fuss than taking the bus at Shah Alam station.

Story end? Not actually :)

When I bought the on-the-spot bus ticket, I confirmed twice with the ticketing agent whether is it a DIRECT bus. Both times they replied is a DIRECT bus, and STRESSED that NOT GOING through Butterworth. Turns out at the end, it still went to Butterworth.

Not really a big deal actually, because it just took a little bit more time before I reached Penang Island at 5pm. I have seen worser case where it took me almost 7hrs from KL to Penang by stopping at Tanjung Malim, Ipoh, Taiping, Nibong Tebal etc. I want to mention it here as a reminder to NOT trust the word of bus ticketing agent about the "service" they promised, and always add buffer to your arrival time to soften your "rage" due to "different expectation". To be clear, I wasnt on rage that day, just an experience sharing =)

Story end? Not actually again =)

The essense of the post starts here actually, and is about the bus driver. It starts like this. I boarded the bus with ticket with no seating number. So, I politely asked the driver "free seating?"

What I had from him is a really really "disgruntled" look and with a fierce reply of "I DONT KNOW LAR! ASK THE OTHER LAR!"

So, what is my reaction? Many of you who knew me well sure guessed that I confronted him, right? Actually I ignored him and went on finding my feng shui seat.

Yes, you hear me right, I ignored him =)

I am not really sure what went wrong with me, is like I have the most "patient" feeling on that day. But of course, I will still remember to blog about the encounter here.

Still about the particular bus driver, at the one and only stop that he made at the gas station for toilet break, the "something wrong" bus driver NOT ONLY SMOKE at the gas station twice, but also USED his HANDPHONE while smoking. I took out my camera wanting to took a picture of the act, but couldnt find an angle with the gas station signboard in it. So, no picture here. Pathetically, is a proof that how ignorant many people are.

The post getting lengthy, right? Anyway, this should be the last point and highlight about the driver, try stay with me a little bit longer, k?

After the gas station, changed driver and the "something wrong" bus driver went on to rest at the rear. Prior to that, he turn on the DVD player and screened a movie called "shot 'em up". Anyone watched this movie before? Well, is an "abnormal" action movie with lots of both "guns & shootings". I can say that the movie is razor thin towards the level of x-rated movie with nudity etc. Freakingly OMG, there are childrens on the bus too. I immediately confirmed that the driver has mental problem. I mean, I have heard of stories saying that x-rated movies were screened on bus express in the past, but this is the closest encounter that I really had on the topic, what an "eye opening".

So, there you have it. What an "extroardinary" trip back to Penang.

On the bright side, at least I was able to keep my composure and arrived safely to Penang. I should be grateful about this, I think.

sign

I remember when I was small, the buses that I took were the very old model type. If it was an air-conditioned bus, I would be considered the luckiest child in the village to go to school on it. Majority of the buses was natural-conditioned, and the windows can be slided open for a cool breeze. It was still nice back then because the weather wasn't as hot as these days.

And because of the sliding windows, kids/people/adults had this bad habit of throwing things/rubbish/anythings out of the bus when the bus is moving. It was a menace/bad habit, and probably little legacy of it still persist among us today.

of course not this adorable school kid who litter =)

Therefore, I think that is why we have this sign below on the bus until today.

the sign says "Dilarang Membuang Sampah Keluar Dari Kenderaan Ini"
simple translation "Do Not Throw Rubbish Out of This Vehicular"
Then again, most of the old model buses were now replaced with the modern, luxury and bigger one. Passenger seats dont have sliding windows anymore and I just couldnt help to think that the sign might be obselete already.

The only sliding windows on the bus today is at the driver seat. Does this mean that the sign is for the driver?

baseless rumour

Early Saturday morning, I received a "rumour" SMS as below from a friend who probably received that from another friend and so on and so on. This is how rumour spread in this technology age, and it is very efficient and fast.

For those who dont understand mandarin, this is what the SMS says...

Anwar has successfully persuaded Sabah's 29 MPs to join the Opposition.
23rd March is the day that Pak Lah have to step down.
At that time, probably the 513 incident will happen again.
Remember to stack rice and food. (pass on the sms to person you care about)
At times, I understand that we need to be paranoid about things, even Intel's Andy Groove once said before that "Only the paranoid will survice" and many intelliers look up to that quote.

BUT!!! There are times also that we need to use our BRAIN to process the facts that being presented to us before jump straight into paranoia, right?

Another blame is, some Malaysian has been taught to be the receiver end of everything, to be an obedient and polite follower at work and at politic, all thanks to the education system or the whole good old country's system. I believe is time to wake up a little bit, and this is the main point I want to make with this post.

I mean, if you think properly about the wording that used in the SMS, do you think that Anwar is the kind of person that like to/will PERSUADE other MPs, especially from the rivals? He dont PERSUADE MPs. He (as well as any other elected MPs) only serve or probably PERSUADE the RAKYAT(people), this is what I believe.

For the 12th General Election Parliament's result, BN won 140 seats while opposition took 82 seats. If there is indeed 29 MPs "jump" from BN to opposition, BN will have 111 seats while opposition with 111 seats as well. It is something like 50-50 shared. At glance, it is a very beautiful number of 29 that make this new composition, but it is unlikely to have such a 50-50 split (but not impossible, only with a very slim chance). This alone has put a question mark to the SMS before you jump into conclusion to stack for food, right?

29 MPs from Sabah??? For cold hard fact, please look up SPR website for the 12th General Election Parliament's result here. There is only 25 Parliament seats allocated for Sabah, where 24 won by BN and only 1 won by DAP. Obviously the number is incorrect.

Undeniably, there are news (not rumour) about negotiation between Opposition and MPs from BN who want to join the opposition, but now obviously some 'evil' parties trying manipulate the agenda for their own benefits.

513? It is something scary in the mind of many Malaysian. It is something that almost everyone wants to avoid and fear of. This alone is evident enough that everyone will make their best effort to contain such incident from happening again. Malaysian are more mature now, dont underestimate people's INTELLIGENCE!!! So, to those 'evil' parties, DONT SIMPLY hang the term "513" besides your mouth for everything, because you just simply making a fool of yourself at times!

Lastly, why these 'evil' parties want to do such thing at first? PROBABLY they hope that such rumours will cause chaos in food supply chain, causing declaration of State of Emergency (darurat) in some states, and follow by another re-election for another chance to regain control in those states. There is another POSSIBILITY that strain in food supply chain will mark up prices or boost sales, making certain people filthy rich. Am just presenting a couple of PROBABLE causes. You do the rest of the thinking. Time to think and not just keep on receiving only.

focal

*********************************************************************************************
small talk:
Is it an evil day or the planets/stars align in an evil formation today?
Because people drive crazily and dangerously today on the road...
*********************************************************************************************

Disclaimer: all the contents in this post/blog are purely my sole opinion/speculation from hearsay and has nothing to do with any other person/entity or representing the view of any company/organization. The accuracy of the content is my pure interpretation at my best knowledge and should be used at your own risk & discretion.

So, how's the overall focal result everyone?

I guess many of you got your result by now, and it is a popular chat-over-the-meal-topic recently that will last for quite a while. For those who still havent got it, even more curious, right?

I myself have the privilege of listening what people have to say about it because I have many friends from the place I used to work for.

So, would like to pen down some of my thought about what I have heard, for you to make a reference at least, and to verify how true it is. I will try to be a fair analyst in this case, hehehe, hope so "p

In General
> The result is not as good as the previous years with SMA (Special Market Adjustment).
> "Successful" performer get an increment between 3% to probably around 9%, which is below 10%.
> majority those "successful" who got below 5% are even pissed.

jason says:
- enjoying SMA for 2 years with double digit % increment has left a high standard of norm to many, and suddenly taking that away from them make them grade this scenario as below norm, thus majority are not quite satisfied/happy about it
- percentage is really a very subjective thing. 5% on RM2000 = RM100, while 5% on RM5000 = RM250. That is 250% difference for a 5%. So, it all depends on your base salary. Some people are happy with the 5%, but many would not be happy. Simply put. ONLY MANAGERS are happy :)
- the company is not an "attractive" place to work in anymore for some people (not all actually). Stock is not performing well/low return. Those who bought SPP and kept them may have their stock devalued due to the getting-lower USD currency while the stock low-performing. Selling RSU or SOP will yield lower revenue compared to a few years back due to USD currency devaluation with the same amount of stock units.

Case1
- personA took grant/scholarship from company to pursue part-time master or PHD program and is bonded to the company for a certain period of time
- personA got "IR" (Improvement Required) this year and very upset about it. Totally no mood to work and went for drink with colleagues that very sad day.
(in case you dont know, getting an IR forfeits the receiver any increment that year and required to undergo some re-training programs in the company to improve his/her performance. It is a "nightmare" that many wouldnt desire)
- some say that because personA is bonded to company due to grant/scholarship, personA's manager or department's managers decided that the bond is a "collateral" that can be used to held personA as "hostage" and they can do whatever they want

jason says:
- from past working experience, I would say there is certain truth about the bond thing being used as "collateral", but this kind of occurance is very rare. The occurances only reflect how 'evil' certain minority managers are, and if you see such 'trait' from certain managers, you better try to get as far as possible from these "evils"
- there is a possibility that personA might have neglected the tasks assigned because have to concentrate on the assignments/papers, but this would be very rare
- is all about managers, wanting or not wanting to excercise bureaucracy or "abuse" their authority. you better work smart

Case2
- personB was sent oversea some time back and is again bonded to the company for a period of time
- personB got "Exceed Expectation" in this year's focal, yet percentage of increment is below 10%
- personB is feeling "average" about the result
- personB found a greener pasture with even better increment and has tender resignation

jason says:
- a wise choice indeed to move on to greener pasture. Good timing as well. The best time to resign is now, where you can have the option to "bargain" (if there is). If resign is still the final fate, make sure your final day is on 30th June, so that you are still entitled to the mid-year bonuses that you deserved. This is a tip!
- again, percentage is a very subjective thing. Probably personB has a very high base salary from the past focal

Case3
- a few personC got promoted in this focal or sent oversea recently so that company can bond them
- simple reason is attrition rate is too high for certain departments and some managers has felt the "heat". Some he/she is the last standing few of seniors/experienced personals that managers will be "crippled" if they do lose them
- promoted people will get more than 10% increment and sent oversea people will enjoy allowances on top of salary and the experience of US liftstyle with low-medium workload. Simply put, is a luxury and vacation to many who had been with the company for quite a while AND managers fond of them.

jason says:
- is a logical sign of desperado managers that will benefit those who are patient enough and took the risk to stay longer with the company
- then again, this has proven that performance based policy for focal is bull at certain extent and all of it boils down to managers. Also proven that the rotation policy and picking the candidate who best-suits the traveling tasks policy are all bullshit. It can be bent easily through bureaucracy.
- is not about how you can work for the managers/company, is about how the company/managers can work for you AND they needed you

EE

## engineers and none-engineers

$EE = "Electronics Engineering";
$field = $_;

if ($field =~ "hardware") {
print "You are in Hardware Engineering\n";
} elsif ($field =~ "software") {
print "You are in Software Engineering\n";
} else {
print "You are neither an engineer nor from $EE. You may not get what I am writting here
\"p\n";
}

Well, dont take it too serious, ok? I simply made up code "p

Anyway, I bet some of the engineers who are reading this did at least try to find flaws in my code, right? Can't help it, isnt it? :)

Let me quote another example, there is an instance where my colleague showed her friend who are not from engineering field the normal day to day emailing with other engineers/couterparts/customers. Her friend were confused!!! Especially with the "english" and logical statement that engineers used. Her friend even quoted...

"What is AR means?" (AR == Action Required; usually means that a task required immediate attention, and commonly someone's name is assigned next to it, and in a worst case scenario, if ab issue occurs, the person usually get into trouble because it is in the record. Cool isnt it, haha :p)

"What is all the capital letter thing with numbers?" (in general, the code used to represent something, such as product code etc)

"Why use all the short form/acronym? If a chair is a chair, just say is a chair lar, why say it differently?" (probably simply because engineers are lazy to type out the whole word; or probably the acronym sounded cool, isnt it ASAP sounds cool?; or simply because engineers like to figure out the acronym by themself, making them feel proud, haha "p)

"The email is dull. I cant understand it. I give up lar" (this I have no comment, haha)

Undeniebly, sometimes engineers really DONT speak "english" or "human" languages. And some even obsessed with lots of data/numbers/graphs/statistics or even images/photos/snapshot/screenshot, you name it :)

So, to all my friends out there who are not from engineering, sorry ya if sometime I really dont speak "human" languages, especially when you asked me what do I do for living :)

But if you are interested, I can try to "translate" them to real english to make you understand, with the condition that the things that I revealed is not Confidential. Oops, almost forgotten about this, engineers are sometimes bound by law to keep secret about their work. Pressure... But what to do, gotta earn a living, right :)

Dont get me wrong, I do have some interest in engineering, that is why I am in it. But I realized that it is not a long term thing. In the mean time still stuck with it until I can figure out what else I can do for living, hehehe :)

went for a series of teambuilding event today with co-workers. It was nice, except that we chose the wrong movie to watched :) we played paintball and have a good lunch together earlier.
Later at night, went for a opposition political ceramah. At last I made it to an actual ceramah umum, and lucky me get to see Lim Guan Eng in person :)
I will try to share some photos when I got more of them and tidied them, stay tune ya

The accuracy of the content is my pure interpretation at my best knowledge and should be used at your own risk & discretion.

Thanks for the comments & support in the earlier post. But I choose to reply with a post instead of comment because I have many things to say, some sort like a behind the scene thingy :)

What I can and want to comment is, the being may be reacted this way because the being probably felt the heat for the letter that I wrote in, submitted to KWSP management and now at the hand of the "parking company" headquarter in KL. So, instead of resolving the issue or trying to improve the condition, the being chose to retaliate/focus on different topic. To me, it is a sign of a typical narrow minded being, or maybe the wordings that I used in the letter was too "inviting", oh my...

The being seems like focusing on attacking me for not keeping the thing wrap and the being dont even understand that what is blogging all about. The being did seems to have delivered some sort of a message to me that if I have anything not satisfied about their service, can directly talk to them. Well, they may be right about this.

But...

If there is any form of existing so called "channel" for me to feedback, I wont resort to express my anger in blog, right? I mean the "parking company" dont even have a decent website or any contact that can be found easily on the parking ticket. They dont even have a decent/bloody feedback channel.

As for finding them directly, I did find them at the small "dungean" at the basement of the building. The moment I entered the "dungean", I almost choked with the "aftermath" of long term heavy "smoking" (that is another issue that I am pursuing about ignorant smokers in the building, but I didnt/restrain from posting it in the blog). Sadly, I cant even find the actual person in charge in the office, I just dont see him around those days, just the being that I dont want to talk to is in the office, passed it the letter, it took a 2 second glimpse at it, told me "ok!". Then told me to talk to KWSP personal directly at 3rd floor instead because this simply came out of the being's mouth "I cant do anything", such a good "fullstop" that leave no space for me to further response.

So, I went up to office again, print another copy of the same letter, and find the person in charge in KWSP at 3rd floor. Fortunately, the meeting with the KWSP personal went very well and very helpful, a very obvious contrast. The personal help me passed up my letters to the "parking company" headquarter in KL. So, I am guessing that the being felt the heat from there since then.

Then there is this one fine day, suddenly all the season passes in my office got blocked although the due date for the next payment havent reach, causing much trouble to the office admin with the being that actually did this, but luckily got resolve on the same day.

So, what I want to say is, I decided to took down the posts because I dont want it to affect the ridiculous being who dont want to resolve the issue but wanting to retaliate, not just to me, but affecting the operation of the place that I work in, and will pursue it in the manner that the being suggested to me to go directly to them. That is why I AM STILL WATING AND SEEING forward for a discussion/debate with them, if they do, which I doubt will, but I will find/nudge them occasionally from time to time.

Ok, I am still angry when writting this post.
cool down...
cool down...

inhale...
exhale...
inhale...
exhale...

ok, fine, better...

Anyway, I felt that I prone to activist work for welfare recently, trying to make a difference at the work environment, trying to voice out the issue that many people having but they just cant afford/take the time/energy to do so.

I felt something different in me, dunno where the up-a-few-levels of gut in me came from, and some gush of adreline that might land myself with many ugly confrontations and other issues which I couldnt imagine and not sure will I be able to handle. Maybe because of the election-vote-for-opposition-fever :)

Anyway, I will still persist and brace myself for anything that comes out from what I am doing. Thanks for the comments and support. At least I felt that I am not alone in this, and felt that what I am voicing does have its ground and you felt the same about it too :)

Till then, I will keep on blogging.

And to the being, if you are reading this, and if you can understand what I am writting, you should know better what I am talking about!

prince

*****************************************************************************************
small talk:
Been missing from blogging for 2days, because I went back home over the weekend and had a real get away rest :)
*****************************************************************************************

excerpt from The Canadian Press

"Prince Harry, home from his abandoned military mission to Afghanistan, says he hopes to return to combat zones as soon as possible."

"Angry would be the wrong word to use but I am slightly dissapointed. I thought I could see it through to the end and come back with our gusy, Harry said after landing in Britain."

"William - the presumptive future king of Britain - has trained as a fighter pilot and is eager to serve overseas"

Coincidently, I am watching "coffee prince" korea drama recently :)

Well, the real message that I want to convey from this posting is...

While there are some minority humble and down to earth prince who really serve their country,

there are still many prince who just do nothing but spending tax payers money on Porche/Ferrari or luxury labels,
or went oversea slacking or having fun in top notch universities,
or know nothing else except expensive sports like golfing,
or dare to challenge the law simply because they have immunity,
or ...

I think it's enough for you to get what I mean "p
